Terms and Conditions
This document sets out the terms and conditions of service (the “Terms”) for Business Utility
Renewals Ltd (“BUR”, “we”, “us” or “our”). These Terms apply once a customer (“you” or
“the Customer”) uses any service provided by BUR.
Please read these Terms carefully before using our services. By using the BUR service, you
confirm that you have read, understood, and agree to be bound by these Terms. If you do
not agree to these Terms, you must not use our service.

Price Comparison / Switching Service
Business Utility Renewals Ltd provides a price comparison / switching service to UK
businesses. To be eligible to use this service you must be;
- A business that is resident in the UK;
- Eighteen years or older (if a sole trader);
- Meet the credit scoring requirements of any supplier (if applicable)
We reserve the right to refuse to provide our services to any customer at our
discretion.
Where you engage BUR, we will use reasonable endeavours to identify, negotiate, and
secure competitive energy prices on your behalf. Prices are obtained from a panel of energy
suppliers using price books provided by those suppliers. Our panel currently represents over
90% of UK business energy suppliers by customer numbers: so, we have a very wide
range to price from.
You agree to provide BUR with accurate information to allow accurate quotations to be
produced, including estimated or actual energy usage, current contract end dates, and any
other known factors that may affect pricing or quotations.
A quotation provided by a supplier through BUR does not constitute an offer to you. Each
supplier’s own terms and conditions will apply to any offer made.
If you accept a quotation and a contract is executed between you and the supplier, that
contract is binding and you will not be permitted to revoke your acceptance. Equally, the
supplier may, at its discretion, decline to accept your acceptance of an offer.
Where you and a supplier wish to proceed, BUR will provide a switching or renewal service,
which includes arranging the contract between you and the supplier for the purchase and
supply of energy.
BUR is not responsible for delays or failures caused by you, the proposed supplier, or any
existing supplier in connection with a transfer or renewal of supply.
Business Utility Renewals Ltd makes no guarantees to either the quality of the
service suppliers offer, or the prices obtained at quotation.
Energy prices can fluctuate daily, and whilst we attempt to help secure competitive
rates to enable switching or renewal, we cannot guarantee any quote is the
cheapest.
The customer is reminded that ultimately it is their responsibility to validate the
accuracy of any quotations presented.
The customer acknowledges that they are entering into a contract with a supplier for
the provision of energy supply and not with Business Utility Renewals Ltd. The
customer agrees that Business Utility Renewals Ltd is not liable in any way for any
dealings, contracts or transactions between the customer and the supplier and that
any such transactions, contracts, dealings or payment obligations are the customers
responsibility and risk.
The customer agrees by using the service that Business Utility Renewals Ltd is an
independent energy brokerage and that Business Utility Renewals Ltd is not
instructed by the customer to act as their agent or representative.
The customer agrees that Business Utility Renewals Ltd are not responsible for the
provision of any supplier services.
Charges
Business Utility Renewals Ltd is remunerated directly by the suppliers and receives a
commission for securing and finalising the contract between the customer and the
energy supplier. This is usually by way of an uplift that is applied within your unit cost
for energy.
The cost of Business Utility Renewals service is therefore included within the cost of
the energy contract that you agree with the supplier — you do not pay BUR separately.
By way of example, we may secure a price for electricity at 15 pence per KWH and
apply a 0.5p uplift. The contracted price we would offer would therefore be 15.5p.
Our commission would be calculated as 0.5p multiplied by your annual energy
consumption and contract term.
Our uplifts depend on the size of contract, length of term and other factors such as
credit risks and value-added services. Our average uplift is just a few percent of your
total energy cost.
Because we get paid by suppliers, we only offer prices from those suppliers on our
panel.
Commission
Commission may alternatively be applied to rates/charges other than the energy unit
rate. Such rates may include (but are not limited to): Meter Standing Charges, Meter
Installation Fees, Meter Operator (MOP) Agreement Charges and DC/DA (Data
Collector/Data Aggregator) Agreement Charges.
The amount of the Commission applied depends on several factors such as, but not
necessarily limited to: (a) the size of the Supply Contract; (b) the contract term; (c)
credit risks; and (d) any additional services BUR may offer or provide, including but
not limited to: (i) account management; (ii) meter reading services; (iii) AMR/Smart
Meter Installation; (iv) business energy audits; (v) setup and access to our cloud
energy monitoring software; (vi) energy management including targeting, proactive
and reactive exception and event monitoring; (vii) bill validation; and (viii) KVA
Analysis and validation.
The amount of Commission to be applied within any accepted Quotation will never
exceed the monetary equivalent of 4p/kWh (four pence per kilo-watt hour) of the
forecast energy consumption (as shown on the Supply Contract) for the contract
duration and can be calculated by multiplying the Commission amount by the
forecast consumption amount for the whole period of the Supply Contract. The
Customer may request BUR at any point to confirm the exact commission BUR
expects from any proposed energy contract.
Entire agreement: These Terms represent the entire agreement between you and BUR in
relation to our services and supersede any prior discussions or agreements on that subject.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the
remaining provisions will continue in full force and effect.
Assignment: You may not assign or transfer your rights under these Terms without our prior
written consent. We may assign or transfer our rights and obligations under these Terms to
another organisation.
Force majeure: BUR shall not be liable for any failure or delay in performing its obligations
where such failure or delay results from circumstances beyond its reasonable control.
No waiver: A failure by either party to enforce any provision of these Terms shall not be
treated as a waiver of that provision.
These Terms, and any dispute arising out of or in connection with them, are governed by the
laws of England and Wales. The courts of England and Wales shall have exclusive
jurisdiction to settle any such dispute.
